Tumisho Masha found not guilty

Actor Tumisho Masha has been found not guilty of assaulting his estranged wife Zozibini Mtongana by the Randburg Magistrate’s Court on Thursday.

The actor issued a statement last week to celebrate his freedom. The case has been running for two years.

Masha’s wife stated in the affidavit that the Saints and Sinners actor had assaulted her and also damaged her phone in June 2016. The case was dropped in November 2016 but it was later reinstated in October 2017.

Tumisho said his wife had rejected his offer after he suggested that he will replace the damaged phone. Instead, the wife demanded money.

“In her judgement, the magistrate said that, in terms of the evidence, the complainant’s statement and the state’s witness did not corroborate each other,” reads Masha’s statement.

Masha was acquitted of assault but found guilty of malicious damage to property for breaking the phone.

According to reports found on Sundayworld, statement stated that his lawyer Clement Dankuru had argued that the matter did not belong to the criminal court.

“His [statement] in court were that no person of presiding officer acting objectively on the set of facts, can reasonably conclude that an assault GBH [grievous bodily harm] had occurred.

“The court gave credence to Mr Dankuru’s version that no weapon was used, and the complainant was not struck with an open or closed hand,” read the statement.
